What is intestacy? Do I ‘need’ a Will?

In dealing with many family law and estate matters, the question of does someone have a Will, is usually much important than people would consider.

The basic principles to consider are;

  1. Marriage and divorce cancel a Will

  2. Separation does not cancel the rights of a spouse

  3. A party to a de facto relationship will have rights after 2 years of continues cohabitation
